The National Agency for the Prevention of Corruption, at its regular meeting, made a decision to approve the results of the inspection of the declaration of Dmytro But, Deputy Head of the Main Investigative Department of the National Police of Ukraine, for the year 2015.
Authorized officers of the NAPC established that there are no grounds for bringing the declarant to administrative or criminal liability. No conflicts of interest or signs of illicit enrichment were detected either. The accuracy of the valuation of declared assets corresponds to the data obtained from available sources.
At the same time, based on the inspection results, it was established that Dmytro But, when submitting the 2015 declaration, violated the requirements of part one of Article 46 of the Law of Ukraine "On Prevention of Corruption". In particular, the declarant did not indicate in section 5 of the declaration information about valuable movable property (a dog), whose value exceeds the established declaration threshold — 100 subsistence minimums set for able-bodied persons as of January 1 of the reporting year. The declaration also did not reflect data regarding the value of real estate objects, 2 apartments, and 2 garages belonging to a family member. According to the declarant’s explanations, the information about the value of these real estate objects is absent due to their disposal and the termination of the family member’s ownership rights to them in 2016.
According to the decision of the NAPC, Dmytro But will be given the opportunity to submit a declaration as a person authorized to perform the functions of the state or local self-government for 2015 with accurate information.
It is recalled that the basis for criminal liability, according to Article 368-2 of the Criminal Code of Ukraine, is the acquisition by a person authorized to perform the functions of the state or local self-government of assets in a significant amount from April 26, 2015, the legality of the acquisition of which is not confirmed by evidence, as well as the transfer of such assets to any other person.
The NAPC carried out a full inspection of the declaration based on the fifth paragraph of part one of Article 50 of the Law of Ukraine "On Prevention of Corruption" — on the information received from individuals and legal entities, from the media, and other sources, about possible inaccuracies in the declaration.
