How the Dubnevych brothers forced smuggler Rostyslav Kysil to pay $1 million: an investigation


«A hunchback can only be fixed by the grave», but that is not said about Rostyslav Kysil. Nothing can correct him anymore. It’s vain to think that years spent in the civilized world somehow compensated for the criminal habits of the businessman instilled during his wild youth. Moreover, the mature Kysil often behaves like a true «outlaw».Emigrants Kysil and ChaykovskyiHe must remember well what «lawlessness» is. In his younger years, Kysil participated in the Lviv organized crime group of Orest Zavynskyi, nicknamed Zavynya. Now it is unclear who was the bigger «outrageous»—Zavynya or his competitors—but in 1994, the boss was taken out, giving all the «torpedoes» from his brigade a visual lesson in «playing without rules». The educational effect was astonishing. Rostyslav Kysil hurriedly left Lviv, moving to Canada. This country was chosen by him deliberately. His distant relatives lived there, and he had tried to organize a trading business with them back in Soviet times.

Perhaps, in his travels abroad, he met another native of Galicia, Ostap Chaykovskyi, or could have met him immediately when he returned back to Western Ukraine with his commercial projects «Rosan» and Meest Express. The fates of the two Ukrainians turned out to be somewhat similar. They both participated in the life of criminal groups, traveled the world.In the criminal environment, Ostap Chaykovskyi had much more weight. Twice in his life, he ended up behind barbed wire, spending about 10 years in prisons. Apparently, Chaykovskyi was quite a determined person. The first time he landed behind bars, he boldly «tricked» Caucasians who bought a large batch of denim clothing from him. Having received a deposit, he sent them a truck loaded with... bricks. His next acquaintance with the «zone» occurred after a fatal car accident involving a child. He was not behind the wheel, but following the code, he took the blame on himself and went to rehabilitate himself again. Chaykovskyi is written about in the past tense because at the end of May 2009, he died in a car accident. The circumstances of his death were quite strange, but the police did not delve into what happened. According to operational information, the businessman Chaykovskyi, who lived in Drohobych, was the «watcher» for the city from the criminal environment. 

Confidence that the case of his death is not clean added the deaths on the next day of his two closest business partners in various places in Ukraine. They had planned to buy several plots of land in the vicinity of the village of Modrychi in the Drohobych district and the «Vernyhora» health resort, located in the settlement itself. Both of Chaykovskyi’s colleagues were also linked to the criminal world. One of them committed suicide using a firearm, and the life of the other was also ended by a fatal car accident.As a businessman, Ostap Chaykovskyi did not reach the heights of Rostyslav Kysil. However, he had to travel the world much more. He lived in Australia and Canada and had extensive connections in the local Ukrainian diaspora. He was considered a very influential person in Drohobych. Without taking leading roles, he could place his protégé in the head of the city administration. He was not a miser either. Chaykovskyi sat in the closed «Rotary Club» and was actively engaged in charity. In his own way, though. In particular, he paid for the installation of a monument to one of his relatives—a member of the OUN who died in battle with NKVD soldiers. He still had some inner core.A Weak Women’s Offender

Rostyslav Kysil cannot boast of such charisma. After his death, all of Chaykovskyi’s business in Drohobych passed into the hands of his lawful wife, Oksana. She became the owner of the construction and production company «Servus», engaged in building frame houses, and the factory for producing parquet boards «Ukkan». Oksana could very well have become the mistress of a real plant—Drohobych Machine-Building—but shortly before his death, her husband got rid of this asset. She had money, and a lot. She could not refuse the request of the quite respectable businessman Rostyslav Kysil, when he asked her to lend money. Moreover, her late husband might have been acquainted with the businessman. Kysil asked for not much, not little, but $1 million. When the time came to return it, he forgot not only about the code but also about ordinary human decency. Kysil had already decided to «trick» the businesswoman.Had her husband been alive, there probably wouldn’t have been any problems with returning the money. Kysil would quickly have been put «on account», but he calculated that the woman would not dare to resort to rough physical force in collecting the debt back. And so it turned out. After Oksana realized that she wouldn’t see the money just like that, she filed a lawsuit. She was lucky to have retained evidence.

In late December 2016, Lviv judge Teslyuk restored justice and ordered the owner of the logistics company Meest Express to repay 27.75 million hryvnias and pay 6,000 hryvnias in court costs. It seemed that the incident should have been resolved, but the fight for the money continued, moving to a completely different plane. Giving up such a large amount of money was unappealing. Kysil was accustomed to fighting for much smaller stakes.

Another «Servus» object

The businessman’s lawyers quickly prepared a complaint to the Disciplinary Chamber of the High Council of Justice, accusing judge Teslyuk of gross violations of procedural law, biased attitude towards one of the parties, and lack of motivation for the decision made.

This is completely against the code! Twenty years ago, for attempting to seek justice in court, all colleagues in the Zavynya organized crime group would have turned away from him like a leper. What Kysil was counting on is unclear. A court decision can only be challenged through an appeal. The Disciplinary Chamber is created to consider completely different issues and does not review the legality of the decisions made. The application was returned to Kysil without consideration. It’s unlikely that Meest Express’s lawyers didn’t warn the owner about the result of such a step. It was simply an attempt at a peculiar and quite petty revenge by Kysil against the judge.A New Shift of «Watchers» from Public Deputies

The twists and turns of the case with the debt are interesting for another reason—constancy in the customs flourishing in the Ukrainian province. In the past, as an option, such disputes could be resolved with the involvement of criminal authorities, the so-called «watchers». Now, they have been replaced by public deputies. Oksana Chaykovska, mobilizing forces before the trial, turned for help to ex-deputy, now Deputy Minister of Health of Ukraine, Roman Ilyk—a native of Drohobych, who during election campaigns was often reproached for ties with local crime in the ’90s. Ilyk has been the long-term leader of the regional organization of the «Batkivshchyna» party and an influential person in the Lviv region. A few calls from him to the judges could only strengthen the businesswoman’s confidence in a favorable outcome of the case.

Brothers Yaroslav and Bohdan Dubnevych

In Kyiv, two other public deputies were closely following the events at home. These were brothers Yaroslav and Bohdan Dubnevych. It was nothing for them to advocate for the offended lady in the High Council of Justice. Both Dubnevychs are experienced people in both business and crime. Their commercial structures supplied gas for the Novoyavorivska and Novorozdilska CHPs. It was purchased by them at preferential prices and was intended for consumption by the population, but in reality, the fuel was supplied for the production of electricity at a free price. The brothers caused total damage of 1.4 billion hryvnias. But that’s just by the way. The main thing is that the mentality of businessmen and politicians is hardly different from that of ordinary bandits.
