Military commissariat employees can impose a fine on a conscript even if he provides his military document during the inspection. There is one nuance that courts take into account.
TRC employees can fine a man by declaring his military registration document in "Reserve+" invalid. This became known from the decision of the Khmelnytsky City District Court dated December 19, 2024, as reported by the Judicial-Legal Newspaper.
Mobilization 2025: What happened
In October last year, a man filed a lawsuit against a fine from the TRC amounting to 17,000 hryvnias. In September, he was stopped for a document check. The paper military ID was left at the military commissariat for MMCmarking, so the Ukrainian showed data in "Reserve+". He also explained why he did not have paper documents with him.
Nevertheless, the conscript was forcibly taken to the TRC. As he explained, he was sure at his military commissariat that information from "Reserve+" would suffice, and he did not receive certificates regarding the temporary withdrawal of the military ID. The man considered the fine decision unfounded and asked for it to be canceled.
In court, it was revealed that the military document presented in "Reserve+" did not have a QR code because the application was not updated. However, TRC employees could verify this data having access to the "Oberih" system and documents proving the Ukrainian’s identity.
Arguments that the paper document had been withdrawn by another military commissariat were deemed insufficiently substantiated by the court. The man’s lawsuit was not satisfied.
Mobilization 2025: What can lead to a fine
The verdict indicates that a military document in the "Reserve+" application without a QR code is considered invalid. If such data is provided during a document check without a paper alternative, it leads to a fine for violating military registration rules during martial law. The minimum fine for this article is 17,000 hryvnias, and the maximum is 25,500 hryvnias.
The court explained that, according to the law, a unique electronic identifier in the form of a two-dimensional barcode (QR code) must be reflected in the electronic military registration document, containing data about the document in the system and subject to scanning.
If the QR code is absent, the document is considered invalid, and its owner may be fined. At the same time, as the details of the case showed, in some cases, simply updating the application may suffice to automatically generate a QR code.
