Prosecutor of the Uman District Prosecutor’s Office in Cherkasy Region, Oleksandr Burlaka, will be dismissed from his position due to his refusal to confirm his disability, — KDKP.
Burlaka has been working in the prosecutor’s office since 2007. Since July 2020, he has had a permanent second-group disability status and has been receiving a pension due to this.
From November until this January, Prosecutor Burlaka, in the office of the head of the Uman Prosecutor’s Office, signed acknowledgments of receiving letters from the acting head of the regional prosecutor’s office and the General Inspectorate of the Office of the Prosecutor General regarding the need to appear at a medical facility for an examination.
However, he did not undergo the medical examination. At the KDKP meeting, he stated that he had analyzed the provisions on the MSEC (Medical and Social Expert Commission) and concluded that a decision by an investigator, prosecutor, a ruling by an investigative judge, or a request from law enforcement agencies is required to verify the validity of its decision. In the absence of such a decision, he believes he has not received any summons to a medical facility to confirm his existing disability group. He considers the letters from the Office of the Prosecutor General and the regional prosecutor’s office leadership to be merely advisory.
The prosecutor did not inform the TRC and SS (Territorial Recruitment and Social Support Centers) about his disability group but was reserved from military service. At present, the regional prosecutor’s office has canceled his deferment from military conscription.
Prosecutor Burlaka, being aware of the public sensitivity of the issue related to the illegal acquisition of disability status by prosecutors during martial law, was obliged not only to comply with the law but also to take all possible measures to protect his reputation and the authority of the prosecutor’s office. Instead, he ignored repeated demands from the leadership to undergo a follow-up medical examination.
