Scandalous mayor of Yuzhnoukrainsk reinstates himself in office

The secretary of the Yuzhnoukrainsk City Council, temporarily acting as the mayor, signed an order on April 15, 2024 to terminate these duties.

After this, Valeriy Onufriyenko personally issued an order on his reappointment to the position of mayor.

“Guided by paragraphs 19, 20 of part 4 of Article 42 of the Law of Ukraine “On Local Self-Government in Ukraine”, in accordance with the decision of the Mykolaiv District Administrative Court dated December 19, 2023 No. 400/3475/22, I continue to serve as mayor from April 16, 2024,” – states the order signed by Valeriy Onufriyenko.

The appointment of the mayor preceded the closure of appeals in the case of Valeriy Onufriyenko, which was recently decided by the Fifth Administrative Court of Appeal.

During a meeting of the deputy commission of the Yuzhnoukrainsk City Council, it was discussed that the court only overturned the decision of the deputies to terminate the powers of the mayor, but did not reinstate him in office.

The position of the state registrar was also expressed, who noted that a return to the exercise of powers is possible only by decision of the Yuzhnoukrainsk City Council, and not only on the basis of a court decision.

At the last session of the city council, the lawyer explained that the court decision did not contain clear instructions on the return of the mayor to his position. To do this, Valeriy Onufriyenko must contact the relevant authority to receive clarification regarding further actions in accordance with the law.

“He is an interested party in resolving this issue. He could go to court to clarify the implementation of this decision. Because, according to the law, the body resolving the judicial dispute, and in our case it is the administrative court, had to decide the issue of renewing him in office. The issue was resolved in an unclear way. The most objective and smart solution in this case would be to go to court for an explanation,” the lawyer noted during her speech.

The next meeting of the Yuzhnoukrainsk City Council is scheduled for Thursday, April 25, 2024.
