The head of the Federation of Employers of Chernihiv region and former deputy head of the State Emergency Service from Oleh Liashko’s party, Oleh Averyanov, was sentenced to seven years in prison. In addition, he was ordered to compensate his ex-wife Yevheniya for material damages in the amount of over 1.5 million hryvnias and 50,000 hryvnias in moral damages.

The corresponding sentence was passed by the Chernihiv Court of Appeal on September 10, 2024. After that, information began to spread on the Internet that Averyanov himself had fled abroad after the court’s sentence.

Took the car and resold it to another person

The subject of the dispute between the former Averyanov spouses after the divorce was a Porsche Cayenne. As stated in the case materials, on January 23, 2015, after a quarrel with his then wife Evgenia, Oleh Averyanov ordered his driver to drive the car away from the house where she lives. It was at that time that the spouses began the process of divorce.

According to Evgenia, the Porsche was her property and registered to her by the previous owner in Averyanov’s absence. Therefore, she regarded the disappearance of her car as theft and filed a police report.

At the same time, Averyanov noted that when he and his wife started talking about divorce, they verbally agreed that the apartment in Priluki would remain Yevheniya’s and the car would be his. He did not admit his guilt and explained that he did not steal the Porsche. He considers it to be joint property that he bought with his own money from the profits he received from his business. He added that he was ready, by court order, to compensate half the cost of the car or return it to his ex-wife.

The case materials also mention that Averyanov sold this car in Kyiv without his wife’s consent - without the relevant purchase/sale documents and re-registration with one set of keys, because he allegedly lost the other one and promised to give them to him later. The ex-wife learned about the sale of the car from the Goloseevsky police department of Kyiv. The buyer of the Porsche also learned from the police that the car had two owners. Oleh Averyanov subsequently returned his money.

What Averyanov’s godmother and ex-wife’s mother say

The Averyanovs’ godmother and Yevheniya’s mother were witnesses in court. The latter said that she has "an excellent relationship" with her son-in-law, and that her relationship with her daughter is generally normal, but sometimes there are quarrels. She also added that she saw the spouses quarrel and the division of property between them during their divorce in 2015.

Regarding the Porsche Cayenne, she says that it appeared in the family in 2014, and it was not a gift, but a joint purchase. After all, both Oleh and Yevheniya used the car. She also confirmed the thesis that there was an agreement between her daughter and son-in-law that she would keep the apartment, and he would keep the car. However, they did not draw up or sign any documents. Yevheniya allegedly consulted with someone later and after that began to express claims against her ex-husband and demanded that he pay her money.

The Averyanovs’ godmother noted that Oleh bought the Porsche Cayenne in question from her husband in February 2014. They had agreed on this purchase back in 2013, when they were vacationing together as families. According to the godmother, after purchasing the car, Yevheniya celebrated, perceiving it as a birthday present.

According to the Supreme Court’s decision, all contracts or certificates of sale of this car were cancelled and declared invalid. According to this decision, Oleh Averyanov must return the Porsche Cayenne to Yevheniya. However, this has not happened yet. At the same time, Averyanov does not remember where the car is, but the working set of keys and the vehicle’s registration certificate were and remain with Yevheniya.

"He did not appear for the full court verdict."

By the verdict of the Chernihiv District Court on October 3, 2022, Oleh Averyanov was found not guilty in the case of illegal seizure of a car. After that, Yevheniya filed another lawsuit in the Chernihiv Court of Appeal to overturn the previous verdict and sentence Averyanov to 10 years of imprisonment with confiscation of property.

She believes that her ex-husband wanted to take the car from her in advance. She also adds that Oleh did not have legal documents confirming him as a co-owner of the car.

The Chernihiv Court of Appeal held its hearing on September 10, 2024. According to the court’s verdict, Oleh Averyanov was sentenced to seven years of imprisonment without confiscation of property. According to Part 4 of Article 532 of the Criminal Procedure Code of Ukraine, this verdict comes into force from the moment of its announcement. At the same time, the term of serving the sentence is calculated from the moment of the actual detention of the convicted person for the execution of the sentence.

Iryna Vynokurova, a representative of the Kyiv City Prosecutor’s Office, told the Public that Averyanov was present at the short reading of the verdict, but did not show up for the full one.

"The full court verdict was to be announced in a few hours. When a court decision is announced, a person is found guilty, but this does not mean that he is immediately detained in court. There is a procedure for executing a court decision. That is, the appellate court must send its decision to the court of first instance, and the court of first instance sends it for execution to the police at the place of residence of the person found guilty."

The press secretary also explained the time frame within which the court’s decisions must be implemented.

"The appellate court has seven days to return this case to the court of first instance for execution. And the court of first instance must send it to the police for execution within three days. That is, in 10 days (from September 21, 2024, - ed.) the police must begin to implement this court decision. And then it will be clear whether the person is going to serve his sentence or is hiding."

The Kyiv Main Police Department did not provide the media with an answer: whether Oleh Averyanov was detained immediately after the court verdict and whether they confirm or deny the information about Averyanov’s probable crossing of the Ukrainian state border. The media also tried to get a comment from Oleh Averyanov himself.

On September 20, the Pozhmashyna company published a video on its Facebook page, where it indicates that their director Oleh Averyanov is at an agricultural exhibition in Poland and congratulates the team on the occasion of Machine Builder’s Day.

This exhibition took place from September 20 to 22 in Bednary, Poland. The website " Kobzarenko Factory" writes about it.

Oleh Averyanov’s ex-wife, Yevheniya, declined to comment.

Averyanov’s lawyer, Darya Svystula, said in a comment that she is guided by the law on advocacy and advocacy, which prohibits her from disseminating information about a client.
