
It concerns inflicting damages in the amount of 92 million hryvnias due to the purchase of diesel fuel at inflated prices.
The High Anti-Corruption Court (HACC) has rendered a verdict in the case concerning damages to PJSC "Ukrzaliznytsia" in the amount of 92 million hryvnias due to the purchase of diesel fuel at inflated prices. In its decision on October 29, a panel of HACC judges found a former representative of an LLC and a former official of PJSC "Ukrzaliznytsia" guilty, reports BіznesCensor citing the court’s press service.
The HACC also satisfied the civil claim of PJSC "Ukrainian Railways." Accordingly, both individuals will be required to pay 102.79 million UAH to the company.
The report does not specify the names of the suspects, but according to the publication "Slovo i Dilo," it refers to the former manager of "WOG Aero Jet" Anatoliy Savych and the former head of the department of petroleum products accounting and warehouse management of the "Production Supply Center" branch of "Ukrzaliznytsia" Valeriy Nikiforov.
Specifically, Savych was found guilty of committing a criminal offense under Part 3 of Article 27 and Part 2 of Article 364 of the Criminal Code of Ukraine.
He was sentenced to 5.5 years of imprisonment with the deprivation of the right to hold certain positions in business entities of all forms of ownership for 3 years. The sentence will commence from the moment of the actual detention of the accused.
The former official of the PSC "Ukrzaliznytsia" Nikiforov was found guilty of committing a criminal offense under Part 2 of Article 364 of the Criminal Code of Ukraine. The court sentenced him to 3 years and 1 month of imprisonment with the deprivation of the right to hold certain positions for 1 year. He was also fined 8500 UAH.
Nikiforov was released under personal commitment and prohibited from leaving the Kyiv region until the verdict becomes legally binding.
At the same time, Nikiforov remained the last suspect personally on trial. The representative of LLC "Wog Aero Jet" Anatoliy Savych, whom the investigation considers the organizer of the scheme, was put on the wanted list back in the summer of 2018. The case materials regarding another suspect, the former head of the PSC branch of "Ukrzaliznytsia" Vitaliy Tsvihun, were separated into separate proceedings in September 2024 because he was mobilized.
As reported, the NABU began investigating this case back in 2017.
According to the investigation, in March 2016, the PSC "Ukrzaliznytsia" and "Wog Aero Jet" concluded a contract for the supply of 100 thousand tons of fuel for 1.4 billion UAH. "Wog Aero Jet" won the tender by offering prices significantly lower than those of competitors.
However, the customer and the supplier then concluded a series of additional agreements to increase the cost of the fuel, despite the absence of any fluctuations in market prices, resulting in damages to "Ukrzaliznytsia" amounting to 92.48 million UAH.
