Corrupt past — not forever: information about administrative offenses will disappear from the register in a year
A law has been adopted according to which information about the imposition of an administrative penalty on an official for committing a corruption offense will be stored in the Register of Corrupt Officials for one year.
The anti-corruption law establishes the terms for storing data in the Register of Corrupt Officials. As analyzed by the "Judicial-Legal Newspaper", the respective changes are provided by the bill 13271-1 adopted on June 17 as a law.
Thus, Article 59 of the "Law on the Prevention of Corruption" has been supplemented with a new Part 4, according to which the term for storing data in the Unified State Register of Persons who have committed corruption or corruption-related offenses (Register of Corrupt Officials) will be:
- data on holding a natural person civilly liable for committing corruption or corruption-related offenses – 1 year;
- data on the imposition of an administrative penalty on a natural person for committing a corruption or corruption-related offense – 1 year;
- data on holding a natural person criminally liable for committing corruption or corruption-related offenses – until the conviction is expunged or removed from the person;
- data on legal entities to which criminal legal measures have been applied in connection with the commission of a corruption offense – 5 years.
After these terms expire, the data about a person in the Unified State Register of Persons who have committed corruption or corruption-related offenses are subject to deletion.
