The friend of Bambizov, Roman Hovda, sold state land for 150 thousand dollars

The illegal appropriation of land in the Hydropark area of Zhytomyr was carried out by employees of the SSU administration in collusion with the head of the regional prosecutor’s office Oleksandr Biloshytskyi, deputy Oleh Mostykhovskyi, and the head of the district prosecutor’s office Oleksandr Bashynskyi. Before the war, the market value of these lands was approximately 700 thousand dollars. The guarantor of the deal was then the first deputy prosecutor general Roman Hovda.

In December 2020, a complaint was filed regarding the commission of a criminal offense related to the privatization of state-owned lands designated for forestry by the Ministry of Defence. Under public pressure, information was entered into the Unified Register of Pre-Trial Investigations under number 12020065020001289, effectively accusing officials of the Main Department of StateGeoCadastre in Zhytomyr region of abusing their official powers during the formation of state-owned land plots on the territory of Teterivska village council and in regulating issues of their privatization.

On the territory of the village council in November-December 2020, several land plots were formed as agricultural, which included forest plantations, ancient oaks, common-use lands, as well as state-owned immovable property (buildings and engineering structures) on the land plots. These lands were designated for forestry purposes for state needs and had a state act for permanent use rights of land plot series YY No. 073507 assigned to SE "Ivano-Frankivsk Military Forestry Industrial Combine of Ministry of Defence" (Shepetivka Military Forestry).

In December 2020, by order of the head of StateGeoCadastre in Zhytomyr region, one of the plots (1822087200:01:000:1235) with an area of 1.1466 hectares was transferred to the ownership of then-acting deputy head of the main division "K" of the SSU in the region Serhiy Masliy, who, by a strange coincidence, is a friend of the regional prosecutor Biloshytskyi and his deputy Mostykhovskyi. Under such circumstances, dozens of other land plots covered with forest plantations were formed and registered as property.

During the investigation, to prevent the illegal withdrawal of these lands from state ownership and to take representative measures, steps were taken to impose arrest on the land plots. However, as mentioned earlier, this story ended with the full support of the scheme by the aforementioned officials, the formalization of the stolen land plot to the head of the main division "K" of the SSU administration in Zhytomyr region Masliy.

Masliy’s lawyer filed motions to lift the arrest imposed on the land plot, but the courts refused to satisfy them due to the presence of activists, the known factual circumstances of the case, and the courts’ unwillingness to get involved in scandals. The last time, by the ruling of the investigating judge of the Bohunsky District Court of Zhytomyr city on 30.12.2021, the removal of the arrest from the land plot with an area of 1.1466 hectares was refused. The investigating judge noted that Masliy had acquired the right to receive the specified land plot only based on an order but does not have the status of an owner (did not have time to register), so according to paragraph 1 of Article 174 of the Criminal Procedure Code of Ukraine, he is not among the persons at whose request the arrest may be lifted.

However, on January 13, 2022, justice prevailed, and by the decision of the investigating judge of the Bohunsky District Court of Zhytomyr city, Masliy’s motion was satisfied, and the arrest imposed by the investigating judge of the Bohunsky District Court of Zhytomyr city on 07.12.2020 in case No. 295/14698/20 on the land plot with cadaster number 1822087200:01:000:1235, with an area of 1.1466 hectares, located on the territory of Teterivska village council, Zhytomyr district, Zhytomyr region, was lifted.

Masliy S. and the organizers of the state land distribution scheme, through realtors, offer to quickly sell the said land plot for 150 thousand dollars (a partial payment option with cash and a car – Toyota Land Cruiser 200 4.5.d is considered). The buyer of this plot does not know that after that, the investigation will be activated, and a lawsuit will appear, and demands will be made for issue resolution.
