Online divorce without children: In 2026, the "Diya" platform will launch a marriage dissolution service by mutual consent

In 2026, the "Diya" app plans to launch an online divorce service. The Ministry of Justice emphasized that e-Divorce will be available only for couples without minor children.

The Cabinet of Ministers has adopted a resolution to launch the experimental project "Electronic Divorce," which provides for the state registration of marriage dissolution in electronic form. The initiative was implemented by the Ministry of Justice in collaboration with the Ministry of Digital Transformation, with support from Switzerland under the EGAP Program, implemented by the East Europe Foundation.

The Ministry of Justice clarified some details regarding online divorce.

Thus, the e-Divorce service will be available to couples who mutually agree to dissolve their marriage and do not have joint children, regardless of any property disputes.

At the same time, as with offline divorces (through the Civil Registry Office or court), the e-Divorce procedure will be fully regulated by the Family Code of Ukraine (FCU). In particular, under the provisions of Article 106 of the FCU, which stipulates that the state registration of marriage dissolution is carried out one month after the submission of the relevant application. During this period, the application can be withdrawn.

The Ministry of Justice reminds that currently, the divorce procedure in Ukraine remains complex due to the requirement of physical presence of both applicants, which creates additional difficulties for citizens living abroad, in remote regions, or with limited physical capabilities.

«Couples without minor children will be able to submit an application for divorce in electronic form through the Unified State Web Portal of Electronic Services, including via the "Diya" mobile app, without visiting the Civil Registry Office. When submitting the application, the system will automatically verify and confirm the data through state registers, including through interaction between the Unified State Demographic Register, the State Register of Individual Taxpayers, and the State Register of Civil Status Acts. Consent to divorce will be confirmed using Diya.Signature.

The registration of the divorce will take place in the format of a video conference with a Civil Registry Office employee in real time. The divorce certificate will be sent to each of the former spouses by postal delivery to the address they specify. The service will operate 24/7 and will be accessible to Ukrainian citizens from any part of the world», — the Ministry of Justice reported.
