The Ivankiv District Court of the Kyiv Region considered a lawsuit filed by a public organization of hunters and fishermen against a poacher. The lawsuit concerned compensation for damage caused by the illegal hunting of a pregnant roe deer. Employees of the gamekeeper service detained a vehicle in the trunk of which was the carcass of a roe deer. The inspection established that the roe deer was pregnant for more than two months, and the cause of death was a gunshot wound from a firearm.

The court of first instance found the poacher guilty of committing an administrative offense under Part 2 of Article 85 of the Code of Ukraine on Administrative Offenses. According to the rates for calculating the amount of compensation for damages, the illegal hunting of a roe deer amounts to 32,000 UAH. Additionally, 50% for each embryo from the illegally hunted animal. The total amount of recovery is 48,000 UAH. The funds are credited to the account of the user of the hunting grounds who suffered the damage.

The public organization of hunters and fishermen has the right to file lawsuits for compensation for damage caused by illegal hunting on the territory of its hunting grounds. The court confirmed this right. The defendant appealed the decision, but the appellate court left the ruling unchanged. This became a precedent for similar cases.

The lawsuit was based on the Law of Ukraine "On Hunting Economy and Hunting". Citizens are obliged to compensate for damage caused to wildlife. Users of hunting grounds have the right to compensation for damages from violators of hunting rules. Judicial practice confirms that returning the illegally taken animal to the environment does not exempt from liability. The amount of recovery takes into account the pregnancy of the animal.
