Former head of the State Tax Service Katrushyn tried to seize 2.5 million hryvnias from a business partner through the court

Former head of the Eastern Regional Department of the State Tax Service Bohdan Katrushyn attempted to seize 2.5 million hryvnias from his business partner Dmytro Nikiforov.

For this purpose, in 2020, he filed a lawsuit with the Shevchenkivskyi District Court of Kyiv to recover a debt of 4.8 million hryvnias based on Nikiforov’s promissory note. The judge approved the “settlement”. Payments were made on time; however, due to the start of the war, some were delayed. In December 2023, private executor of the Kyiv enforcement district Fesyk Mariya initiated enforcement proceedings for the compulsory execution of the court decision.

Fesyk stated the need to collect 1.56 million hryvnias plus her fee of 156.5 thousand hryvnias. The businessman paid everything the next day. On December 6, Fesyk issued a ruling on the completion of the enforcement proceedings, but on December 7, she canceled it, citing that she had not taken into account the penalty, inflation index, and 3% per annum on the overdue amount. She calculated 3.5 million hryvnias and demanded the arrest of movable and immovable property for 2.14 million hryvnias. On December 20, 78 thousand hryvnias were debited from the businessman’s card under this proceeding.

Fesyk’s actions grossly violated the enforcement proceedings procedure, as stated in the ruling of the Kyiv Court of Appeal dated March 25, 2025. Currently, a criminal proceeding has been registered against the executor under Part 2 of Article 367 of the Criminal Code of Ukraine.
