Court refused customs officer with Russian passport: Ablyazimov lost reinstatement case

Ayder Ablyazimov with a Russian passport was not reinstated through the court - the Transcarpathian customs officer lost the case.

The customs officer, who was dismissed after my investigation into the Russian passport, failed to return to his position.

On April 14, 2026, the Kyiv District Administrative Court refused to satisfy the claim of the former deputy head of the No. 1 Anti-Smuggling Department of the Transcarpathian Customs, Ayder Ablyazimov (surname according to the passport of a Ukrainian citizen).

He sought to cancel his dismissal, reinstate himself in the position, and receive payments for «forced absenteeism», but the court sided with the customs office.

In court, Ablyazimov claimed that:

  •  the information about him having RF citizenship is unreliable and falsified
  • the RF citizen’s passport could allegedly have been issued without his knowledge or using his personal data
  • the polygraph results he provided allegedly confirm that he did not obtain RF citizenship
  •  he was dismissed during his vacation, which, in his opinion, is a procedural violation

The court did not accept these arguments because:

  • no documentary evidence of falsification or forgery of the passport was provided
  • the polygraph is not a proper and admissible proof in such cases
  • the letter from the SSU Department in Transcarpathian Region was deemed a sufficient official proof by the court
  • the law does not provide for the need for additional checks upon receiving such information

The court also separately noted that, according to the law, having foreign citizenship is an unconditional ground for termination of public service, and the appointing entity is obliged to dismiss the official within the specified period.

For reference, on May 11, 2014, an internal RF citizen’s passport was issued in Ablyazimov’s name; on June 3, 2025, I published a photo of this passport; on June 4, 2025, he was dismissed from the Transcarpathian Customs; after that, he filed a lawsuit seeking to cancel the dismissal and reinstate himself in the position; the case was heard in simplified proceedings without summoning the parties, with the SSU Department in Transcarpathian Region involved as a third party.

By the decision dated April 14, 2026, the court confirmed that the dismissal was lawful and there are no grounds for reinstatement in service.
