Mobilization under 25: lawyer explains in which cases men can be called up
In Ukraine, men under 25 are generally considered conscripts, so age alone is not a basis for their mobilization. However, there are exceptions in the legislation. If a young man has already been included in the category of those liable for military service, he may be subject to conscription during mobilization.
This was stated by lawyer Yevhen Fylypets on his own YouTube channel.
The expert explained the cases in which a man who has not yet reached 25 may have the status of a person liable for military service.
After the maximum age for mobilization was lowered from 27 to 25, men under 25 in most cases remain conscripts. At the same time, the law provides for certain cases when a person of this age already has the status of liable for military service.
In particular, this may apply to men who were previously recognized as limitedly fit for military service. If they received this status before the age of 25, they could be transferred from the category of conscripts to those liable for military service.
After the cancellation of the “limitedly fit” status, such citizens must undergo a military medical commission again. If the commission recognizes them as fit for service, they may be subject to mobilization before reaching the age of 25.
A separate category includes graduates of military departments. If during their studies a man completed the relevant military training and received a primary officer rank, he acquires the status of liable for military service. If there are grounds provided by law, this may allow his mobilization before the age of 25.
Former employees of the National Police with special ranks may also fall into the risk group. After dismissal, they may be transferred from special to general military registration, as a result of which they acquire the status of liable for military service.
The problem may arise not only from legal status but also from an error in military registration data. For example, a man who by law should remain a conscript may be mistakenly classified as liable for military service.
Therefore, men under 25 are advised to check the accuracy of information about themselves in the military register, particularly in the “Reserve+” app. If the status was changed without legal grounds, it can be clarified and, if necessary, appealed.
Thus, being under 25 does not guarantee absolute protection from mobilization. What matters is which category of citizens a person belongs to in the military register and on what grounds he was granted the status of liable for military service.
