Unlawful dismissal from "Ukrnafta": Pavlo Savchuk has won the case in court

On September 18, 2024, the Lokhvytsky District Court of the Poltava Region ruled in favor of Pavlo Savchuk, former Deputy Director for Legal and Corporate Affairs of PJSC "Ukrnafta" and JSC "Ukrtatnafta," recognizing his dismissal as illegal.

The court not only reinstated Savchuk in his position but also ordered the company to pay him his average monthly salary for the period of forced absence, amounting to more than 4.6 million hryvnias. Pavlo Savchuk commented on the court’s decision:

"I was unlawfully dismissed from my position, with which I categorically disagreed and filed a lawsuit. The court took a long time to review the case, and representatives of JSC ’Ukrtatnafta’ were constantly coming up with something, but ultimately my claim was satisfied, and all illegal orders by Koretskyi (Serhiy Koretskyi, Director of PJSC ’Ukrnafta’ and JSC ’Ukrtatnafta’ - Ed.) were annulled."

However, the court’s decision has not yet been implemented. "As of now, Koretskyi, as the director, is violating the Constitution of Ukraine and has not fulfilled the court’s decision on my reinstatement and salary payment, so this will be enforced compulsorily within the framework of enforcement proceedings," says Savchuk.

According to him, there is a high probability that the company will file an appeal, trying to avoid implementing the court’s decision.

Savchuk also explained the circumstances of his dismissal, emphasizing that his work became inconvenient for the management after he refused to follow certain instructions:

"Managers come to a state-owned enterprise and behave as if it is their private firm. When the Koretskyi back-office unlawfully interferes with your work - you become an enemy, when you refuse to follow the instructions of Oksana Voinets (Koretskyi’s deputy - Ed.), and then suddenly a new position ’legal advisor’ is created for a specific person, and you, as an undesirable element, are not allowed into the workplace by security guards, and it is marked in the timesheet that you are absent from work. As a result, I was dismissed for an alleged absenteeism. Why did this happen? You should ask Koretsky if you can find him," said Savchuk.

Moreover, he shared his thoughts about the situation.

"I believe that this cannot and should not happen at a state-owned enterprise, especially during martial law. They just took advantage of the fact that no one comes with inspections and controls them, so they do whatever they want. I hope that in the future we will see independent inspections that will sort out what is really happening at the state-owned enterprise," says Pavlo Savchuk.

Interestingly, according to sources, Ihor Sadovyi, the head of the personnel management department at "Ukrnafta", who is suspected of bribery, still works for the company.

It is reported that, according to the investigation, the suspect, holding the position of head of the management department of PJSC "Ukrnafta," in 2018 offered his acquaintance to use and process 30 hectares of land at her own expense, which was in the possession and control of "Poltavanafthaz" management of PJSC "Ukrnafta."

The suspect received the unlawful benefit in several stages. Law enforcement officers detained him under Article 208 of the CPC of Ukraine while receiving the second part - 80 thousand hryvnias.
