Fines issued by the State Tax Administration after July 17 this year for failing to update military records can be contested in court due to the expiration of the one-year period for administrative liability, said lawyer Dmytro Morhun.

He notes that people have previously succeeded in contesting fines for summons issued in absentia, because in order to violate the law, one must be aware of it. And when a summons is considered delivered even without the person receiving it, they are not aware of it.

However, the expiration of the period does not apply to, for example, being declared wanted by the State Tax Administration employees.

«The fact is that the Code of Ukraine on Administrative Offenses does not regulate issues related to this search at all. Until now, such a concept as a search for administrative liability did not exist at all. From a legal perspective, the authority to detain a person and deliver them to the State Tax Administration and State Service for Special Communications is a violation of their constitutional right, namely the right to freedom of movement», Morhun stated.
