NACP claims it does not conceal officials’ declarations

The National Agency for the Prevention of Corruption reported that it does not classify declarations of officials. A corresponding statement appeared from NACP.

The thesis is being spread in the media that the NACP is allegedly classifying declarations. We explain why this is not so. The Declaration Resumption Act stipulated that until the end or lifting of martial law, declarations of certain categories of employees would not be publicly displayed for security reasons. After all, the state, in the context of a full-scale invasion, must ensure the safety of declarants and their family members.

Declarants, under a number of conditions, have the right to withdraw from public access all documents available in the register, namely, declarations and notifications of significant changes in property status filed for all periods. Such conditions may apply to both the declarant and his family members.

In October last year, the NACP developed and, by order dated October 12, 2023 No. 221/23, approved a procedure for removing declarations of such persons from public access.

According to the procedure, the decision on the existence of grounds for withdrawing a declaration rests solely with the initiator of the submission, according to which the NACP withdraws the declaration for public access. The national agency emphasized that the initiator could be the head of the Central Executive Committee, the chief of the General Staff of the Armed Forces of Ukraine, the head of the local council and others.

The NACP, on its own initiative, does not seize documents available in the register of declarations and is not obliged to check the existence of grounds for making a submission.
