In Ukraine, there is consideration of possible changes to the rules regarding the use of land plots during martial law. Specifically, there is a plan for the temporary forced suspension of the right to use land that is privately owned, for the construction of engineering and fortification structures. The relevant draft law has already received government approval.

This was reported by the representative of the Cabinet of Ministers in the Verkhovna Rada, Taras Melnychuk. He noted that the document also includes the possibility of:

  • terminating this restriction;
  • buying out or forcibly withdrawing a land plot or its part.

In addition, it proposes the introduction of special rules for the forced temporary deprivation of the right to use a land plot or its part. This includes:

  • drawing up an act of forced temporary deprivation of the right to use;
  • defining the procedure for making decisions on the termination of such a restriction;
  • defining the procedure for the buyout of the plot or its part.

"The draft law ’On Amendments to Certain Legislative Acts of Ukraine in the Field of Land Plot Use, Necessary for the Construction and Maintenance of Military Engineering and Fortification Structures under Martial Law’ has been approved," the statement said.

It is worth noting that the approval of the draft law by the government does not guarantee its automatic implementation. For the mechanisms defined in it to take effect, the document must be supported by the people’s deputies and signed by the president.

At the same time, deputies have the opportunity not only to make changes to the draft law but also to return it to the Cabinet of Ministers. The president also has the right to veto the document—and in such a case, even with the support of parliament, the law will not come into force.
