Scandalous developer Roman Bahmut seizes a plot of land through Brovary City District Court

In the Brovary City District Court, a case related to the scandalous construction on Vasyl Symonenko Street is under consideration. According to local activists, developer Roman Bahmut has found common ground with Judge Nataliya Petryshyn, leading to a series of decisions that could be interpreted as facilitating the raiding of a land plot.

As reported by local activists, “several years ago, when an appeal regarding possible illegal construction in Brovary came to the editorial office, we got acquainted with Judge N. Petryshyn. In the cases under her consideration where Roman Bahmut was involved, metamorphoses occurred: a party to the case attended hearings only by personal invitation from the judge: ‘come, because there is some press’, the decisions were made considering the participant’s status, especially in cases of traffic violations.

Following the public outcry over the scandalous construction and numerous problems for residents, equally loud hearings took place, at least for Brovary. New owners could not lift the liens from their homes and still cannot. But now the new owners of the “flats in the air” decided to start with the land.

Under the individual houses where the “flats in the air” are located at the following addresses: Symonenko St., 41/1, 41/2, 41/3, 41/4, 41/5, there are five land plots still owned by Roman Bahmut. One was sold last year at a state auction, and this particular plot is not being developed and is privately owned by an individual.

So, to the Brovary City District Court, almost identical applications from the association of co-owners of apartment buildings (OSBB) “MONA” began to arrive to the land plot owners, demanding the transfer of the land to them. The cases are considered by Judges N. Pysanets and N. Petryshyn, and they issue truly opposite rulings.

The case 361/8771/24 is under the consideration of Judge N. Petryshyn, and as has become customary in all cases regarding Roman Bahmut, the decision was made in favor of Bahmut. By the ruling dated September 6, 2024, a lien was placed on the land plot, the very one sold at auction and privately owned by an individual and intended for individual residential construction.

The OSBB “MONA” failed to purchase this plot for itself and negotiate peacefully, now trying to take it from the legitimate owner. It remains a big question how legally the OSBB “MONA” was created as a legal entity in the blocked individual residential building erected on land plots intended for individual residential construction on Symonenko St., 41/1, 41/2, 41/3, 41/4, 41/5. Also, most importantly, this land plot is not developed, but Judge Nataliya Petryshyn somehow interprets it differently in her ruling.

Another case 361/8358/24 is being considered by Judge N. Pysanets, there the judge does not see the necessity in securing the claim by imposing liens on land plots for individual residential construction, where individual residential houses have been factually built, in which apartments are illegally registered.

The OSBB “MONA” filed for securing the claim twice, and both times it was denied. Absurd! Whether it is a coincidence, or the surname Bahmut is not as well-known yet in Donetsk region, or liens have already been imposed on these land plots, or the legal entity has no authority to reclaim land from individuals—it is unclear. But one thing is clear, judges who are not biased make more balanced decisions.”

We ask this journalistic investigation to be considered an official request to NACP, NABU, and SBI, asking them to verify the actual assets and declarations of the Brovary City District Court Judge Nataliya Petryshyn for undeclared or illegal income, given that some judicial decisions involving her show signs of corrupt actions.
