The courts are considering whether the summons from the Military Commissariat was delivered to men through the "Ukrposhta" tracker.

Thus, the Eighth Administrative Court of Appeal established that the summons was not delivered due to the absence of the recipient at the specified address on October 15, 2024, while the Military Commissariat summoned the man for October 14. The court decided that the man was not properly notified.

Also, the Third Administrative Court of Appeal on February 28, 2025, established that the summons was not delivered due to the absence of the recipient. There was no evidence provided that the man was aware of the postal item, nor was it established by the court that the mail was accessible on the day of its arrival.

In both cases, the penalties from the Military Commissariat were canceled.

It is worth noting that in both cases, the men were not subject to mobilization: one had a deferment, the other was recognized as disabled. The court examined the correctness of the notification procedure.
