Deferment from mobilization: how much time TRCs have to review an application
The consideration of an application for deferment from mobilization at the Territorial Recruitment Center (TRC) has legally established timeframes. According to general rules, the commission must review the application within seven calendar days from the date of its receipt.
However, in certain cases, this period can be extended to 15 days.
Lawyer Yuriy Ayvazyan explained that the commissions at the TRC have restrictions in their activities in accordance with legislative requirements. They are obliged to make a decision regarding the application, whether it is positive or negative, within a clearly defined timeframe.
If additional information is required from government bodies or other state institutions to make a decision, the review period can be extended, but no more than 15 calendar days.
"When the commission has sent relevant requests to government bodies or other state institutions to obtain information, the review period for the application and documents that confirm the conscript’s right to deferment does not exceed 15 calendar days," noted the lawyer.
If a response to the request is not received within this period, the commission is obliged to make a decision based on the documents provided by the applicant.
