The Supreme Court considered Poroshenko’s lawsuit regarding the lifting of sanctions against him
Today, the Cassation Chamber of the Supreme Court of Ukraine held a session regarding the appeal against sanctions imposed on the Member of Parliament from the "European Solidarity" faction and the fifth President of Ukraine, Petro Poroshenko. Poroshenko filed a lawsuit demanding the cancellation of President Volodymyr Zelenskyy’s decree, which enacts the decision of the National Security and Defense Council to impose personal sanctions against him, reports "Espreso".
It is reported that representatives of the Ministry of Economy and the National Security and Defence Council were not present at the meeting. Poroshenko opposed holding the hearing behind closed doors, but the defendant’s side insisted on it.
Before the session began, the deputy noted that five months had already passed since the court began reviewing the decision to impose sanctions against him. He added that the court gave the authorities 15 days to provide a full list of reasons for imposing the sanctions.
"In 128 days, they haven’t provided a single word. They are not ignoring Poroshenko. They are ignoring the Supreme Court," he emphasized.
He believes that the lack of legal grounds indicates the "political nature" of imposing sanctions to fight against the opposition and freedom of speech in Ukraine.
"My advice, if you deceived Volodymyr Zelenskyy, then admit it and advise him to cancel the decree... The sanctions are illegal, the sanctions are unconstitutional, the president’s decree should be canceled," Poroshenko states.
The representative of Ihor Kolomoiskyi filed a petition to merge his case of challenging the National Security and Defence Council’s sanctions with Poroshenko’s case. However, representatives of the fifth president opposed the merger of the cases. The Administrative Cassation Court of the Supreme Court denied Kolomoiskyi’s petition, journalists from "Ukrinform" report.
In April, the Administrative Cassation Court of the Supreme Court rejected Poroshenko’s request to suspend the sanctions.
The exact reasons for the sanctions against Poroshenko remain unknown, and even he cannot challenge the imposition of restrictions in court on the merits, as they are based on financial monitoring data, which is classified. At the same time, the media’s published "justifications" for the restrictions are not entirely truthful and contain distorted information, writes the editor of the politics department Inna Vedernikova in her article "Sanctions against Poroshenko: Zelenskyy’s demobilization chord or a way to retain power?" The author notes that despite all the statements by Poroshenko’s supporters about the illegality of the sanctions imposed on him, they are legal.
