Investors of the residential complex "Yakorya" became victims of the fraudster Ihor Kurylko

Developer Ihor Kurylko, with the aim of gaining superprofits, built the residential complex "Yakorya" (Anchors) on a land plot designated for a kindergarten.

Now, according to the law, he does not have the right to put the residential complex into operation, something that the State Architectural and Construction Inspectorate has repeatedly warned the building fraudster Kurylko about even during construction.

For instance, on July 28, 2017, the State Architectural and Construction Inspectorate (SACI) of Ukraine in the Odesa region issued an order to halt preparatory and construction works due to detected violations.

Even the fines issued did not stop the fraudster Kurylko, and he continued building the frame of the residential complex. As a result, he built two of the four sections on the plot where, according to the General Plan, there was supposed to be a kindergarten. Kurylko himself at one time promised to build social infrastructure.

Since developer Ihor Kurylko refused to comply with the legal requirements of the regional SACI (requirements of the order), according to current legislation, a decision was made to cancel the registration of the declaration on the commencement of construction work.

Thus, further work on the site after the cancellation of the permitting documentation was illegal. This is the second reason why Kurylko will never be able to put the building into operation.

The absolute legality of the actions of SACI in the Odesa region was later confirmed by the Odesa Appellate Administrative Court.

As investors of the residential complex "Yakorya" reported, after the cancellation of the permitting documents, the entire residential complex received the status of illegal construction, which means that the next step will be the opening of a criminal case and the submission of a claim by the local authorities for the demolition of the illegal construction.

The Lyman district state administration sees no other option, as there is a huge deficit of preschool institutions in the area and there is no sense in compromising with another building fraudster.

Residents of the 11-year-long construction project "European" believe that Ihor Kurylko will treat the investors of "Yakorya" the same way he treated them. He will not fulfill his obligations, disappearing with some cheap excuse.

It is noteworthy that the "European" residential complex is literally 20 meters away from the "Yakorya". Ihor Kurylko collected money from hundreds of investors in the "European", but never put the building into operation, orchestrating a fictitious bankruptcy through the Odesa Regional Economic Court. Later, to avoid criminal prosecution, Ihor Kurylko, through a bribe, registered the ownership of the unfinished "European" complex and transferred it to the investors. To this day, people are completing the residential complex at their own expense, while Kurylko, having stolen millions of dollars, has remained unpunished.

It is possible that Ihor Kurylko never intended to put the "Yakorya" residential complex into operation, which is why he resorted to blatant law violations.

The situation is also complicated by the fact that during construction Kurylko allowed other serious violations. In particular, all four sections, including the two built on the kindergarten land plot, were erected without architectural and technical supervision.

This means that the reliability and safety of the "Yakorya" residential complex is not guaranteed.

It turns out that the "Yakorya" residential complex will never be put into operation. This is simply impossible because:

1) part of the residential complex was built on a land plot that was exclusively allocated for a kindergarten;

2) most of the work was conducted after the cancellation of the declaration on the commencement of construction work, i.e., illegally. For this reason alone, the "Yakorya" residential complex cannot be put into operation;

3) prior to the cancellation of documentation, Ihor Kurylko conducted construction without the mandatory architectural and technical supervision.

- This is a construction deadlock. Investors of the "Yakorya" residential complex have the right to apply to the developer Ihor Kurylko with a statement about the termination of the contract and the return of funds. In case of refusal to satisfy the legitimate demands of investors, it is necessary to go to court to enforce the collection of funds from Ihor Kurylko’s property.

Of course, so that Kurylko cannot resell his property, it will be necessary to impose an arrest on all his assets and ban him from leaving Ukraine, - said lawyer Anatoliy Stepanenko.
