The entourage of Stolar-Kushnir received interest from the billion allocated for the metro to Vynohradar

"Kyivmetrobud" thanks to the Cabinet of Ministers of Volodymyr Hroysman has received the opportunity to secure 95% advance payment for the construction of the metro line to Vynohradar valued at UAH 5.99 billion, a part of which was placed on deposit and subsequently the interest earned was transferred to affiliated companies.

This is evidenced by the decision of the Pechersk District Court of Kyiv dated December 10.

In November 2018, «Kyivmetrobud» won the tender for the construction of a metro line from the «Syrets» station to the Vynohradar residential area valued at UAH 5.98 billion.

According to the contract, the «Kyiv Metro» was supposed to provide «Kyivmetrobud» with an advance payment of 30% of the contract amount, which had to be used within three months.

However, on December 20, 2018, the parties signed an additional agreement that increased the advance payment from 30% to 95%. Additionally, the period for using this advance was extended from 3 to 24 months.

The basis for such actions was the resolution of the Cabinet of Ministers dated December 18, 2018, in which then Prime Minister Groysman set the maximum prepayment rate for works on the construction of the Syretsko-Pecherska metro line section at up to 95% of the works’ cost under the contract for a period not exceeding 24 months.

As the investigation notes, the adoption of this resolution was lobbied by unknown individuals through "corrupt connections in the Cabinet of Ministers" in order to increase budgetary expenditure and redirect funds to companies they and their accomplices controlled, contrary to the procurement principles defined in Article 3 of the Public Procurement Law, namely maximizing savings and efficiency.

Between 16.01.2019 and 25.03.2019, according to the «Spending.gov.ua» website, UAH 2.5 billion of budgetary funds were transferred to the account of OJSC «Kyivmetrobud» as an advance payment.

As established by the investigation, in May 2019, officials of «Kyivmetrobud» deposited over UAH 1 billion of budgetary funds in «Ukrgazbank» deposit accounts to earn profit in the form of interest and to further enrich themselves. In fact, budgetary funds were used not for the purposes defined in the procurement contracts for goods, works, and services, in violation of the provisions of the Cabinet of Ministers Decree No. 117 dated 23.04.2004.

Subsequently, the income received in the form of interest from deposit agreements was transferred by «Kyivmetrobud» into the accounts of LLC «Profi-Factoring». The latter, in turn, transferred this money to the accounts of LLC «Deorbud», LLC «FC «Faktor-Servis», LLC «Rul», LLC «Aven-Ezer», and LLC «Faktor Standard». On December 10, the court seized these accounts.

A criminal proceeding regarding this fact was initiated in May 2019 under the supervision of Kyiv Local Prosecutor’s Office No. 6.

The founder of LLC «Deorbud» is the Cypriot company «Kanetro Holdings Ltd», whose beneficial owners are Indian citizen Kumar Kuldeep and Dmytro Marmulyak from Kremenchuk. These individuals are also listed as the ultimate beneficial owners of LLC «Rasmus».

«Rasmus» was established in 2013. From 2013 to 2016, 50% of this enterprise belonged to Viktoriya Polukhina. Since 2017 and until recently, Polukhina has been the founder of LLC «Magnat Stroyservice Ltd», which is currently owned and led by Mykhailo Stolar. He is the father of Vadym Stolar, a People’s Deputy from the OPFL party. After 2014, Vadym Stolar became known as the "gray cardinal" of the capital. As is known, he has interests in construction and real estate.

Since 2016, the founder of LLC «Rasmus» is the Cypriot company «Asodria Holdings Ltd», whose ultimate owners are listed as Kumar Kuldeep and Dmytro Marmulyak. The latter was the director of LLC «Profinans Group» during 2013-2016, later replaced by Larysa Kryvoruchko, who became the founder of the firm. She is the wife of Volodymyr Kryvoruchko. Together with the current chairman of the board of OJSC «HC «Kyivmiskbud» Ihor Kushnir, in 2010 they became deputies of the Kremenchuk City Council from the Party of Regions. It was in Kremenchuk where Kushnir built up his career.

LLC «Deorbud» is the contractor for the construction of the Time residential complex at Vasylya Lypkivskoho St, 38, and the Salut residential complex at Druzhby Narodiv Blvd, 2 in Kyiv.

The ultimate owner of «Profi-Factoring» is Kyiv resident Andriy Savchenko. The founder of «FC «Faktor-Servis» is LLC «New Finance Partners», owned by the Cypriot company «Stock Market Security Pat Limited». The founder of LLC «Rul» is the Kyiv company «Frubelsa Ukraine», registered to Azerbaijani citizen Elmar Mammadov. The founders of LLC «Aven-Ezer» are Serhiy Ponomarenko and Petro Levchenko. In turn, «Faktor Standart» is registered to LLC «Senyorage», whose founders are Dmytro Ivanov and Ihor Tereshchenko.
