Who among the employees in the educational sector is entitled to a deferral from mobilization

Not all educational workers are entitled to a deferment. This only applies to cases where the teacher is employed in the school in a main position, not concurrently.

In Ukraine, martial law and mobilization of those liable for military service continue. However, certain categories of the population have the right to deferment, including educational workers. Not all educators can receive it. The article by "RBC-Ukraine" reports on who among educators has the right to deferment and what to do if such a person receives a summons despite having a "reservation".

Who has the right to deferment from mobilization

The following subjects are not subject to conscription:

• scientific-pedagogical and scientific workers who teach in institutions of higher and professional pre-higher education and have a scientific degree;
• workers who teach in professional pre-higher, vocational, and secondary education institutions.

However, they are entitled to deferment from mobilization only if they work on a 0.75 employment rate. If a teacher works on a half-time basis, they are subject to mobilization.

According to the "mobilization" law, employment in an educational institution must be the primary job, not concurrent. Therefore, employment should be at least 0.75 of a position.

It should be noted that deferment is only granted to scientific and scientific-pedagogical workers. Laboratory assistants, methodologists, librarians, and other specialists working in educational institutions do not have the right to deferment.

The procedure for processing deferment is defined by the respective government resolution. Verification of grounds for granting it and processing are carried out by territorial recruitment and social support centers.

What to do if an educator receives a summons

In this case, a scientific, scientific-pedagogical, or pedagogical worker who has a deferment should come to the TRC with:

• a statement for deferment addressed to the head of the TRC in two copies, one of which is kept with a registration mark;
• originals or notarized copies of written evidence confirming the grounds for deferment.

Documents that confirm the grounds for deferment include:

• the original certificate signed by the head of the educational institution about employment in this institution at the main place of work, indicating the name of their position(s) and their teaching load at the position as a percentage of the rate;
• a notarized copy of the document certifying the receipt of an academic title and/or scientific degree (for scientific and scientific-pedagogical workers).
