Shufrych will perform his parliamentary duties from the pre-trial detention center
The Shevchenkivskyi District Court of Kyiv has obliged to grant the right to perform parliamentary duties to the People’s Deputy of Ukraine from the banned party OPFL, Nestor Shufrych, who is accused of state treason. However, he will not be able to participate in plenary sessions of the Verkhovna Rada.
This is evidenced by the decision of the Shevchenkivskyi District Court, a copy of which was published by the People’s Deputy from the parliamentary faction "European Solidarity," Oleksiy Honcharenko, on Telegram.
"During the preparatory court hearing on the mentioned criminal proceedings, defendant Shufrych N.I. filed a motion to ensure his rights as a People’s Deputy of Ukraine, specifically regarding the possibility to perform parliamentary duties and participate in plenary sessions of the parliament," the court’s decision states.
It is noted that this motion is conditioned by the fact that the powers of People’s Deputy Nestor Shufrych have not been terminated in the manner prescribed by law.
Shufrych and his defenders demanded that he be granted the right to perform parliamentary duties, specifically to be transported from places of detention to the sessions of the Verkhovna Rada and to have conditions created for using a work computer.
After hearing the opinions of the parties involved in the criminal proceedings and examining the available materials, the court concluded: "…the powers of Shufrych N.I. as a People’s Deputy have not been terminated in the manner prescribed by the Law of Ukraine ’On the Status of a People’s Deputy,’ and Shufrych N.I. has not been found guilty of the alleged offenses by a court verdict, therefore, in the understanding of Article 62 of the Constitution of Ukraine, his guilt in committing any offenses has not been proven at this time. Thus, the court concluded that to realize the rights of the defendant Shufrych N.I., who is a People’s Deputy of Ukraine, there are all legal grounds to oblige the authorized persons responsible for ensuring proper conditions during the detention of the defendant under the applied preventive measure to take measures to ensure the rights of the latter regarding the realization of his powers as a People’s Deputy of Ukraine in the form and manner determined by the current legislation," the document states.
At the same time, Shufrych’s demands regarding his transportation from the pre-trial detention center to plenary sessions of the Verkhovna Rada and the creation of conditions for using a work computer were not to be satisfied.
Therefore, the parliamentarian can perform parliamentary duties only within the framework of his stay in the pre-trial detention center.
According to Honcharenko, the court sent the decision to the Verkhovna Rada for consultations, "…because, according to the regulations, a People’s Deputy can vote on bills only in the session hall. Thus, Shufrych will not be able to vote. But theoretically, he can participate online, for example, in committee meetings. Or submit bills and resolutions through assistants."
