Pro-Russian deputy Boyko won another case against the NAPC
The People’s Deputy and head of the commission for the dissolution of the political party "Opposition Platform – For Life" Yuriy Boyko won another case against the National Agency on Corruption Prevention (NAPC).
This was reported with reference to the data from the court registry.
This time, the NAPC’s administrative protocol came under the consideration of Judge Oleh Bilotserkovets of the Pechersk District Court in Kyiv. The document stated that Yuriy Boyko did not submit reports on the property, income, expenses, and financial obligations of the OPFL party for 2021-2022. According to the National Agency, this is a violation of Article 17 of the Law of Ukraine "On Political Parties in Ukraine".
The deputy did not attend the hearing but submitted written explanations through the court’s office. The politician claimed that the activities of OPFL are prohibited in Ukraine based on court decisions. Since October 5, 2022, the party has been in the process of liquidation. Boyko added that it is not within his responsibilities as the head of the liquidation commission to submit financial reports of the political force to the NAPC.
Judge Bilotserkovets agreed with the arguments of Deputy Boyko. The text of the court’s decision indicates that the NAPC, within its competence, exercises state control specifically over the activities of political parties. Regarding the political party whose activities are prohibited and terminated, it does not have the obligation to submit reports to the NAPC.
"The case materials do not contain evidence indicating that the head of the commission for termination (liquidation commission) Yuriy Boyko is an official who, according to legislation, is obligated to submit the political party’s report on property, income, expenses, and financial obligations," the court’s decision stated.
At the same time, another judge of the Pechersk District Court in Kyiv, Svitlana Hrechana, while considering the NAPC’s administrative protocol against Deputy Yuriy Boyko for not submitting the OPFL party’s report for the II-IV quarters of 2020, concluded that the head of the liquidation commission Yuriy Boyko was obliged to submit the party’s financial reports. However, at that time, the deputy avoided punishment because the statute of limitations for administrative liability had expired.
