Relatives of missing persons will be able to receive a deferment from mobilization, — MIA
Previously, obtaining a deferment for the relatives of missing persons required a court decision, but the Cabinet of Ministers made changes.
Starting from January 14, 2025, the relatives of missing persons in special cases will be able to actually receive a deferment from mobilization, as the Cabinet of Ministers eliminated the previous legal conflict that hindered this. This was reported by the press service of the Ministry of Internal Affairs.
The government approved a resolution establishing an updated list of documents required by families of missing persons to obtain such a deferment.
Before the adoption of this resolution, the basis for obtaining a deferment from mobilization was a court decision recognizing a person as missing under special circumstances. However, the current legislation did not provide a legal procedure for issuing such a court decision, and therefore families of missing persons could not obtain a deferment.
Now the procedure for obtaining a deferment for families of missing persons will comply with the requirements of the relevant law, replacing the need for a court decision with an extract from the Unified Register of Missing Persons. Thus, relatives will need to obtain an extract from the Register instead of a court decision.
The Ministry of Internal Affairs also reminded that the category of persons entitled to a deferment from military service mobilization includes, in particular:
- women and men whose close relatives (husband, wife, son, daughter, father, mother, or full or half brother or sister) went missing while defending Ukraine and during martial law;
 - women and men (or guardians) who are raising a child (children) under the age of 18, if one of the parents of such a child (children) is recognized as missing or absent without a trace.
