A resident of the Lviv region won a lawsuit against a TRC

A resident of Lviv region won a court case against the Territorial Recruitment Center for ignoring his request for a deferment from mobilization. The Lviv District Administrative Court satisfied the claim of a father of many children, who has a second group disability, after the military enlistment office did not respond to his three applications for deferment.

The man submitted three requests for a deferment from mobilization from May 2023 to February 2024, attaching documents confirming his disability and status as the father of three minor children.

He sent the latest application at the end of February 2024, and according to tracking data, the TRC received it at the beginning of March. However, the man received no response.

The court, after reviewing all the materials of the case, found the inaction of the TRC illegal. Judge Rostyslav Kuzan emphasized that such behavior violates the plaintiff’s rights to have his application considered. As a result, the TRC was obliged to review the man’s application for deferment from mobilization. The court’s decision can be appealed.
