"Limited fit" were warned about a fine for not passing the MMC
Citizens who were previously deemed partially fit must undergo a repeat military medical commission by February 5th, otherwise, they will be required to pay a fine. They will not be summoned for the medical commission; they need to do it themselves.
This was stated by a member of the Verkhovna Rada of Ukraine’s Committee on National Security, Defence, and Intelligence, Fedir Venislavskyi, in a comment to the YouTube channel RBC-Ukraine.
It should be noted that citizens who were previously deemed partially fit have less than three weeks to undergo the medical commission. This must be done by February 5th, otherwise, they will face a fine of 17 to 25.5 thousand hryvnias.
Venislavskyi reminded that according to the new law, the term "partially fit" has been abolished in Ukraine. Additionally, the transitional provisions of the law clearly state that within 9 months, those who were previously deemed "partially fit" are required to undergo a repeat medical commission to determine fitness for military service under the new standards.
"This law has come into force. The 9 months are passing. Accordingly, the question arises for those who did not comply with the law’s requirement. This does not require any separate regulation at the Cabinet level. There is no conflict here," said the MP.
According to him, there are no legal grounds for appealing or justifying the failure to undergo the repeat medical commission within the 9-month period.
"Citizens had the time to comply with the law’s requirement. Those who did not comply will be held accountable for failing to adhere to the legislative provisions. The responsibility for violating military registration rules, which are part of these rules, is established by administrative responsibility, which has been in place for decades," Venislavskyi noted.
He explained that the Cabinet’s decree, providing for a summons, indicates that mobilization activities are being conducted. However, this is another law that stipulates that in the case of a draft of a citizen who is liable for military service, they must receive a summons and undergo the medical commission.
"We are talking about another category that does not need to be summoned because they are not being mobilized. They should have complied with the law and attended the medical commission," added the MP.
